These conditions of sale are concluded by the company BAIT SHAM SAS

Registered in the Perpignan Trade Register under number 843974130, hereinafter called BAIT SHAM and managing the site www.baitsham.com and on the other hand, by any natural or legal person wishing to make a purchase via the website www. baitsham.com, hereinafter referred to as “the buyer”.
Article 1: object
These conditions of sale aim to define the contractual relations between BAIT SHAM and the buyer and the conditions applicable to any purchase made through the website www.baitsham.com. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, of which the buyer acknowledges having read prior to finalizing his order.
The company BAIT SHAM retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.
Article 2. Products
The products offered are those which appear on the website www.baitsham.com of the company BAIT SHAM, while stocks last. The BAIT SHAM company reserves the right to modify the assortment of products at any time. Each product is presented on the website in the form of a description listing its main characteristics. The photographs are as faithful as possible but do not commit the seller in any way. The sale of products presented on the site www.baitsham.com is intended for all buyers residing in countries which fully authorize the entry into their territory of these products.
Article 3. Prices
The prices appearing on the product sheets in the internet catalog are prices in Euros (€) all taxes included (TTC), VAT applicable according to current legislation. The company BAIT SHAM reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased depending on the total amount of the order. A flat rate contribution to shipping costs will be invoiced to the buyer.
Article 4. Order and payment terms
Before any order, the buyer must create an account on the website www.baitsham.com. The account creation section is accessible directly from the menu or during the ordering process. At each visit, the buyer, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using this information.
The BAIT SHAM company offers the buyer the opportunity to order and pay for their products in several stages, with 2 payment options to choose from. The BAIT SHAM company will ship the products no later than 2 working days after receipt of the transfer corresponding to the order, subject to provisions, but will not fail to mention in specific cases other delivery times (limited series published individually , bulky products requiring shipping by carrier, etc.).
– Secure payment by credit card or PayPal: the buyer selects the products he wishes to order in the “basket”, modifies it if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the delivery method.
BAIT SHAM cannot guarantee delivery times and their smooth running in the event of incorrect or incomplete entry of Names, First Names, emails, mobile phones and postal addresses, perfectly spelled and detailed.
Next, the buyer chooses the payment type of their choice. In this case: “Payment by Bank Card” or “Payment by PayPal”. The next step asks him to check all the information, read and accept these general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the “Confirm my order” button. Finally, the buyer is redirected to the secure Payment by Bank Card or PayPaL interface, in order to securely enter their personal bank card or PayPal details. If payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card or PayPal is irrevocable. In the event of fraudulent use of this card, the buyer may demand the cancellation of the card payment, the sums paid will then be re-credited or returned. The liability of the bank card holder is not incurred if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of their card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the card holder must contest, in writing, the debit with their bank, within 70 days following the transaction, or even 120 days. if the contract binding him to it so provides. The amounts withdrawn are reimbursed by the bank within a maximum period of one month after receipt of the written dispute filed by the holder.
No costs for returning the sums may be charged to the holder. Confirmation of an order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of the right to rely on one's own conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an e-mail address and if he has entered it on his order form, the company BAIT SHAM will send him by e-mail confirmation of the registration of his order. Article 5. Reservation of ownership
The BAIT SHAM company retains full ownership of the products sold until full payment of the price, in principal, fees and taxes included.
Article 6. Withdrawal
Under article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from delivery of their order to exercise their right of withdrawal. See Withdrawal and Return Conditions.
Article 7. Delivery
Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders are made by the companies offered during the ordering process.
– Chronopost, parcel point or home delivery service, delivered with or without signature. In the event of home delivery, the package will be dropped off at Relais Colis in the event of the recipient's absence or the delivery person's inability to find the address and/or notify the recipient. Delivery times are given for information purposes only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The BAIT SHAM company will be able to provide the buyer with the tracking number of their package by e-mail or SMS. The buyer is delivered to his home or to Relais Colis by the transport company. The buyer is required to check, in the presence of the delivery person, the condition of the packaging of the goods and its contents upon delivery. In the event of damage during transport, any protest must be made to the carrier immediately, either by refusing the damaged package or by issuing a written reservation on the delivery note of the delivery person.
– Colissimo or other delivery solutions, if available: Same verification procedures in the presence of the delivery person and protest in the event of a damaged package or doubt.
Article 8. Warranty
The guarantee does not apply to perishable food products, for other products the legal guarantee provided for by articles 1641 et seq. of the Civil Code applies. In the event of non-compliance of a product sold, it may be returned to BAIT SHAM who will take it back, exchange it or reimburse it. All complaints, requests for exchange or refund must be made by post to the following address: BAIT SHAM, 7 Rambla du vallespir, 66100 Perpignan, France within thirty days after delivery. The warranty does not apply under any circumstances to product misuse or negligence.
Article 9. Liability
The company BAIT SHAM, in the distance selling process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.
Article 10. Intellectual property
All elements of the site www.baitsham.com are and remain the intellectual and exclusive property of the company BAIT SHAM. No one is authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.
Right of withdrawal and return terms
– Return of products: You have a maximum of 14 days of withdrawal. Returned Products must be in perfect original condition, accompanied by their original packaging, unopened, undamaged and accompanied by their invoice.
– For perishable products, the product must be perfectly sealed, perfectly preserved and packaged in its original condition. The expiry date must be long enough to allow the product to be resold once it has been received by our services. -Any request for withdrawal must be the subject of a direct and express request to our services and after allocation of a returns number. Do not under any circumstances return your products directly.
– We reserve acceptance of reimbursement based on the condition of the returned product, consistent with the original condition, in perfect condition for resale, and for perishable products, according to the expiration date.
The interior and exterior condition of the products must allow resale as NEW.
– Refund: The refund will be made within 14 days after receipt of the products in original condition, returned according to the protocol cited above, and in accordance with the original and expiry state of the product.
– Return costs remain entirely your responsibility.
